YOUTOPIA Terms and Conditions of Use
The purpose of these Terms and Conditions of Use (hereinafter "TCU") is to govern access to and use of the website https://youtopia-sports.com and the Android and iOS application "YouTopia Sports" (hereinafter "the Site") by any user, as well as all information, opinions and/or services offered therein.

By connecting to or browsing the Site, you acknowledge that you have read and understood these GTCU and agree to comply with them without reservation.

We invite you to read them carefully before using the Site. If you do not agree to the terms, please refrain from using it. You may print or download a PDF copy of the Terms for reference.

The legal notices on the Website and the Privacy Policy https://www.youtopia-sports.com/privacy-policy form an integral part of the Terms and Conditions.

The Website is published by YOUTOPIA SPORTS SRL, registered with the Crossroads Bank for Enterprises under number 1015.462.514, with its registered office at Boulevard du Roi Albert II 4, 1000 Brussels, Belgium (hereinafter referred to as "YouTopia"). The website is hosted by Webflow, Inc., a company incorporated under American law with its registered office at 398 11th Street, 2nd Floor, San Francisco, CA 94103, United States. The application, backend and database are hosted by Microsoft Azure, with its registered office at Brussels National Airport, Passport Building, 1K Luchthavenlaan, 1930 Zaventem, Belgium. I. Modification of the Terms of Use and the Website - Information
Unless otherwise required by law, YouTopia reserves the right, without prior notice and at any time, to modify, suspend or discontinue any feature of the Website, to supplement its content, or to remove or modify certain products or services, or even to close the Website. Any changes or modifications to the Website shall take effect upon publication of the new version of the Website. Any updates to the Terms of Use shall apply as soon as the new version is posted online. It is therefore recommended that you consult the Terms of Use regularly to be aware of any such updates.
The information on this site is as accurate as possible and is provided for informational purposes only. Unless explicitly stated otherwise, it does not constitute a contractual commitment. However, despite the diligence taken in updating the Site, some information may have changed since it was last verified.
 
If a user discovers an error, omission or malfunction, they are invited to inform YouTopia by describing the problem in as much detail as possible (page concerned, type of device and browser used, etc.) at the following email address: info@youtopia-sports.com.
II. Jurisdiction
The Website is intended for Belgian residents. In other countries or jurisdictions, the situation may differ depending on local laws and regulations. As a user, it is your responsibility to verifythat access to the Website, as well as its use and the use of the information it contains, comply with the legal provisions in force in your country or jurisdiction. If your use of the Website does not comply with these rules, please immediately cease browsing the Website.
III. Responsibilities

   i. Disponibilité du Site et des Services
   YouTopia Sports strives to ensure continuous access to and proper functioning of its application and services. However,    access may be interrupted for maintenance, updates or in the event of unforeseeable failure. No uninterrupted or error-    free access is guaranteed.
   
   ii. Limitation of Liability
      YouTopia Sports cannot be held liable for service interruptions or damage caused in particular by (non-exhaustive list):
     • Malfunctions of the Internet or telecommunications network;
      • Failures of the user's equipment (smartphone, tablet, computer, etc.);
      • Delays, errors or interruptions in data transmission;
      • Illegal interference by third parties (hacking, data theft, etc.);
     • Any damage to the user's computer equipment due to bugs or computer viruses, or any other technical malfunction or        failure ;
      • The bankruptcy of any third party or supplier with whom YouTopia collaborates for the proper functioning of the Site.
 
   iii. Force majeure
        The following are considered cases of force majeure (non-exhaustive list):
        o Unforeseen technical failures of the Internet network;
        o Virus epidemics, cyber attacks (massive spam, Trojan horses, critical bugs);
        o Server failures not attributable to YouTopia Sports;
        o Natural disasters, fires, floods, internal or external strikes, acts of terrorism, war.
 
   iv. Links to third-party websites
       Currently, YouTopia Sports does not provide links to third-party websites. Should this change, YouTopia Sports reserves          the right to establish such links and will then specify the terms and conditions for any requests.   

b. User responsibilities
    The user of the application undertakes to:
    • Use the application in accordance with the law, the general terms and conditions of use and good morals;
    • Respect the rights of third parties (image rights, privacy, intellectual property);
    • Provide accurate, complete and up-to-date information;
   • Not compromise the security or proper functioning of the application (in particular through viruses, malware, harmful programmes );
    • Not use the application for fraudulent, commercial or unauthorised advertising purposes;
   • Ensure the confidentiality of your login details and assume responsibility for any unauthorised use resulting from your negligence.

   If YouTopia is held liable as a result of the User's failure to comply with their obligations underthe Terms and Conditions, applicable law or regulations, YouTopia reserves the right to take action against the User and claim compensation for damages.
IV. Intellectual property
All content on the application (text, illustrations, graphics, logos, images, videos, sounds, interfaces, databases, source code, technical developments) is the exclusive property of YouTopia or used under regular licence. Furthermore, as the content of the Site is computer software, Belgian and European copyright legislation applies.

The name "YouTopia Sports" is currently used as a distinctive trademark. No trademark has been officially registered. However, the following domain names are protected: youtopiasports.com and youtopia-sports.com. YouTopia owns all economic and copyright rights to: (i) the published content, (ii) the conception and design of the application, (iii) the technical developments and source code (excluding open-source elements) and (iv) the specific photos, illustrations and logos.

Any reproduction, representation, adaptation, publication, distribution or use, in whole or in part, without prior written authorisation is strictly prohibited and would constitute an infringement punishable by law.
V. Nullity and non-waiver
If one or more clauses of these Terms and Conditions are deemed invalid or unenforceable for any reason, YouTopia undertakes to adjust them only to the extent necessary to make them valid. In any event, the invalidity of one provision shall not affect the validity and enforceability of the other provisions, which shall remain in full force and effect.

The fact that YouTopia does not exercise a right or does not invoke one of the provisions of these Terms and Conditions shall not constitute a waiver of that right or provision in the future.

Any complaints relating to the use of the application or these Terms and Conditions may be addressed:

VII. Jurisdiction and applicable law
The execution and interpretation of these Terms of Use, as well as the relationship arising therefrom, are subject to Belgian law, unless otherwise required by mandatory legal provisions in the country where the User is primarily resident.

In the event of a dispute, the parties nevertheless undertake to attempt to resolve any dispute amicably, if necessary through mediation. If no amicable solution can be found, the courts and tribunals of the district of Brussels shall have jurisdiction to hear any dispute arising from the interpretation or execution of these Terms of Use.
VIII. Archiving and deletion of personal data
Any data, file or document stored by YouTopia in accordance with its privacy policy may be considered as proof of interaction between YouTopia and the user.

The user may delete their account at any time via the application. Deletion of the account will result in the immediate deletion of personal data, unless its retention is required by a legal or regulatory obligation, in accordance with YouTopia's Privacy Policy.

In the event of a legal obligation, the data is securely archived for the legally required period and then permanently deleted.
IX. Privacy and Cookie Policy
The Cookie Policy and the Privacy and Data Protection Policy form an integral part of these Terms of Use. These are published on the Website and govern all use of the Website. We recommend that all users read them carefully in order to understand their rights and obligations in this regard.
